The claims in this matter, which sound in negligence, arose out of a motor vehicle accident which took place on or about March 23, 2009 along the Ewarton Main Road, in the parish of Saint Catherine. It involves motor car registered 3161ES owned and driven by Clement Powell and motor vehicle CF9421, owned and driven by Donald Beam. Osbourne Whyte and deceased, Patrick Clunie, were travelling as passengers in the motor vehicle driven by Clement Powell, while Barrington Gardener was a passenger in the vehicle driven by Donald Beam.
